1. Scope and acceptance

By browsing this website, placing an order or downloading a product, you agree to these Terms. If you do not agree, please do not use the shop.

We may update these Terms as the shop changes. The "last updated" date at the top of this page always reflects the current version. The version in force when you place an order applies to that order.

2. What we sell

TUFF MIDI sells digital products — MIDI compositions, bundles and related creative material — delivered as downloadable files. No physical goods are shipped.

• Product pages describe the content, format and scope of each product.
• You need your own software (a DAW) and instruments/sounds to use MIDI files. MIDI files contain note data, not audio.
• We may update, extend or retire products at any time. Retiring a product does not affect the licence for a product you already bought.

3. Orders, prices and payment

Presenting a product in the shop is an invitation to order. A contract comes into existence when your payment is confirmed and we confirm the order by email.

• Prices are shown in the currency displayed at checkout and include applicable VAT or sales tax where required.
• Merchant of Record: our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all orders, handles payment, invoicing, tax and refunds, and its own terms apply to the payment transaction.
• You are responsible for entering a correct email address at checkout — your download link and invoice are sent there.
• We may refuse or cancel orders in cases of suspected fraud, chargeback abuse or obvious pricing errors.

4. Delivery and access

Delivery is immediate and fully digital. After a successful payment you receive a download button on the confirmation page and a download link by email.

• Download links are personal and time-limited for security reasons. If a link has expired, contact hi@tuffmidi.com and we will issue a new one.
• You are responsible for downloading and storing your files. We recommend keeping your own backup.
• Access can be revoked if a purchase is refunded, charged back or obtained fraudulently.

5. Licence — 100% royalty-free

When you buy a TUFF MIDI product, you receive a perpetual, worldwide, non-exclusive, non-transferable licence to use the MIDI compositions it contains.

You may

• use the MIDI in your own musical productions, including commercial releases, beats sold or leased to artists, sync placements, films, games, ads and streaming;
• modify, arrange, edit, transpose, chop and combine the MIDI with your own material;
• render the MIDI with any instruments and sounds you like;
• register your own finished song containing the MIDI with your PRO, distributor or content-ID system.

You may not

• resell, redistribute, share, give away or upload the MIDI files themselves, on their own or repackaged in a MIDI, sample, preset, template or loop pack;
• claim authorship of the underlying MIDI composition as a standalone work;
• register an unmodified MIDI composition, or a track consisting essentially of it, with a content-identification system in a way that blocks other legitimate customers;
• use the files in AI training datasets or in any service that redistributes them as raw content;
• share your account, download link or files with third parties.

The licence is granted to one person or one company. Producers working in a team need one licence per person. The licence is perpetual and survives the end of these Terms, unless it is terminated because a purchase was refunded or charged back — in that case the licence ends and you must stop using and delete the files.

6. Ownership and intellectual property

We keep ownership of the MIDI compositions, artwork, text, audio demos, video and branding on this website. You own everything you create with the MIDI — your own arrangement, recording and master. Nothing in these Terms transfers copyright in the underlying compositions to you.

7. Right of withdrawal and refunds

Consumers in the EU/EEA and the UK have a statutory right of withdrawal of 14 days. For digital content delivered immediately, that right expires once you have expressly consented to immediate delivery and acknowledged that you thereby lose the right of withdrawal (§ 356 (5) BGB) — you confirm this at checkout.

Independently of the statutory rules, we voluntarily offer a 14-day money-back guarantee on all digital products. Details, the withdrawal wording and the request form are on our Refunds & Withdrawal page. Requests reach us at hi@tuffmidi.com; refunds are processed by Paddle to your original payment method.

8. Emails and newsletter

We send transactional emails for your orders (confirmation, download link, invoice) — these are part of the contract and cannot be opted out of. Marketing emails are opt-in only and every one of them contains an unsubscribe link. See the Privacy Policy.

9. Acceptable use of the website

• Do not scrape, crawl, mirror or bulk-download the website, its previews or its files.
• Do not circumvent download limits, paywalls, access tokens or security measures.
• Do not upload or transmit malware, or attempt to probe, overload or disrupt the site.
• Do not use the website for anything unlawful.

10. Warranty and liability

Statutory warranty rights for digital products apply. If a file is faulty, incomplete or does not match its description, contact hi@tuffmidi.com and we will repair, replace or refund it.

Apart from that, the website and products are provided "as is". We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are only liable where an essential contractual obligation is breached, and then limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. We do not guarantee any commercial success, placements or revenue from using our products.

11. Governing law and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the mandatory protection of the law of your country of residence.

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
