1. Our approach
- Every MIDI file on TUFF MIDI is uploaded by a user (the Uploader), who must have the rights to share it.
- TUFF MIDI does not pre-screen uploads and cannot verify that every Uploader owns what they claim to own.
- When we receive a complete and credible copyright complaint, we act on it, usually by removing or disabling access to the reported content.
- Uploaders who repeatedly infringe may lose their account.
2. Reporting allegedly infringing content
If you own the rights to a work, or are authorised to act for the owner, send a written notice to [DMCA EMAIL]. You can also use the report control on the MIDI file page, but formal notices should be sent by email so we have a written record.
Please include
- Your name, address, phone number and email address.
- Identification of the work you claim is infringed (for example the original track, MIDI pack or composition).
- The exact URL(s) on TUFF MIDI of the content you want removed.
- A statement that you have a good-faith belief the use is not authorised by the rightsholder, its agent or the law.
- A statement that the information in your notice is accurate and — under penalty of perjury where that concept applies — that you are the owner or authorised to act on the owner's behalf.
- Your physical or electronic signature.
Incomplete notices may delay processing. We may forward your notice, including your contact details, to the Uploader unless prohibited by law.
3. What we do after a valid notice
- We may remove the content or disable downloads and previews for it.
- We notify the Uploader and tell them why the content was removed.
- We keep an internal record of notices for repeat-infringer tracking.
- We may take further account action where the circumstances justify it.
4. Counter-notification / disputing a removal
If your MIDI was removed and you believe this was a mistake or misidentification, you may dispute the removal by writing to [DMCA EMAIL] with:
- Your name, address, phone number and email address.
- Identification of the removed content and the URL where it appeared.
- A statement that you have a good-faith belief the content was removed as a result of mistake or misidentification.
- Any consent to jurisdiction or service of process that applicable law requires — [JURISDICTION / COURT DETAILS TO BE CONFIRMED BY COUNSEL].
- Your physical or electronic signature.
5. Repeat infringers
Accounts that are the subject of repeated valid copyright complaints may be suspended or terminated. We decide this case by case, taking into account the number and seriousness of the complaints and whether the Uploader disputed them.
6. False or abusive complaints
Submitting a knowingly false copyright complaint, or using this process to harass another producer or remove competing content, is a breach of our Terms of Service. We may reject further notices from that sender, restore the content and suspend related accounts. Knowingly false statements may also carry legal consequences under applicable law.
7. Complaints outside the United States
We accept copyright complaints regardless of where you are based. If you are notifying us under a non-US framework (for example EU or UK law), please say so and include the same information listed in section 2, plus any details your local framework requires. Our handling of notices and any statutory response times are subject to the law that actually applies to [LEGAL ENTITY NAME] in [JURISDICTION].
